5.2 Pokémon Content

Pokémon and all related trademarks, characters, names, and distinctive likenesses are the property of Nintendo, Creatures Inc., Game Freak, and The Pokémon Company. We do not claim any ownership of Pokémon intellectual property. Our Services aggregate and provide access to publicly available information about Pokémon Trading Card Game products for informational purposes only.

5.3 Your Content

Any data, information, or content you submit through the Services remains your property. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display such content solely for the purpose of providing and improving our Services.

6. Payment Terms

  • Any errors in the Services will be corrected
  • The data provided through our API is complete, accurate, or up-to-date

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL POKÉWALLET, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Services
  • Any conduct or content of any third party on the Services
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any other matter relating to the Services

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100 USD, WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless PokéWallet, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Services
  • Your violation of these Terms
  • Your violation of any third-party right, including intellectual property or privacy rights
  • Any content you submit through the Services

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at hello@pokewallet.io or through your account settings.

13.2 Termination by Us

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice, effective immediately. Grounds for termination include, but are not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Non-payment of fees
  • Request by law enforcement or government agencies

13.3 Effect of Termination

Upon termination:

  • Your right to access and use the Services will immediately cease
  • Your API keys will be revoked
  • We may delete your account and associated data after a reasonable period
  • Provisions that by their nature should survive termination will survive

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Updating the "Last updated" date
  • Sending an email notification (for significant changes)

Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Services.

15. Dispute Resolution

Any disputes arising from these Terms or the Services that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority, rather than in court, except that you may assert claims in small claims court if your claims qualify.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PokéWallet regarding the Services and supersede all prior agreements and understandings.

16.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, or internet failures.
